Poolyse – Pool water analysis mobile app

1. Purpose

These Terms of Sale (hereinafter the “Terms”) define the terms for selling paid services offered by the Poolyse app.
By downloading the Poolyse app or taking out a subscription, the user fully and unreservedly accepts these Terms.

2. Description of services

Poolyse offers:- a limited free trial, including a limited number of analyses and temporary access to Premium features
- a Premium subscription providing full access to analyses and advanced featuresThe available features are described in the app.

3. Access to the app

Access to the app requires:
- a compatible smartphone,
- an Internet connection,
- the creation of a user account.
The publisher cannot be held liable for interruptions or unavailability related to the network or external factors.

4. Subscriptions and prices

Poolyse offers one subscription plan:
- Subscription (monthly / six-monthly / annual): access to all advanced features.
Prices are indicated in euros, including all taxes, and may vary by country according to store rules (Apple App Store / Google Play Store).
The applicable prices are those displayed in the app at the time of purchase.

Subscription amounts are managed and billed by Apple or Google, depending on the store used.

5. Payment

Payment is handled by:
- Apple (App Store) for iOS users,
- Google (Google Play) for Android users.
The user must comply with the terms of use of these platforms.
The Poolyse publisher does not store any banking data.

6. Renewal and cancellation

Subscriptions renew automatically unless cancelled by the user at least 24 hours before the due date.
Cancellation must be made:
- through Apple account settings for iOS,
- through Google Play for Android.
Poolyse cannot issue refunds, in accordance with Apple and Google rules.
For any refund request, the user must contact the relevant store.

7. Right of Withdrawal

In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for:
- digital content supplied immediately after purchase and whose performance began with the user's prior consent.
By purchasing the subscription, the user acknowledges:
☑ immediate performance of the service,
☑ loss of the right of withdrawal.

8. Liability

Poolyse provides recommendations based on the analyzed data, for guidance only.
The user remains solely responsible for:
- maintaining their pool,
- the chemical products used,
- compliance with safety standards.
Poolyse cannot be held liable in the event of:
- measurement error,
- incorrect use of test strips,
- water alteration due to incorrect dosage.

9. Intellectual Property

All elements of the Poolyse app (design, texts, algorithms, images, logo…) are protected by applicable laws.
Any reproduction, distribution, or modification is strictly prohibited without authorization.

10. Personal Data Protection (GDPR)

Poolyse collects only the data necessary for operating the app:
- email,
- analysis history,
- user preferences.
This data is stored securely and is never sold to third parties.
The user has the following rights:
- right of access,
- right to rectification,
- right to erasure,
- right to data portability.

11. Changes to the Terms of Sale

Poolyse reserves the right to modify these Terms of Sale at any time.
Users will be informed through the app or by email.

12. Governing Law

These Terms of Sale are governed by French law.
In the event of a dispute, an amicable solution will be sought as a priority.
